Terms of Service

These Terms of Service ("Terms") govern your access to and use of DateVibe ("DateVibe", "the App", "the Service", "we", "us", "our"), a dating application operated by Xavier Ballesteros, based in Montreal, Quebec, Canada. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and the operator of DateVibe.

You must be at least 18 years of age to use DateVibe. By using the Service, you represent and warrant that you are 18 or older. DateVibe is not intended for anyone under 18, and we do not knowingly allow minors to use the Service. We may request proof of age at any time and may terminate the account of any user who misrepresents their age.

You must be a real human individual. Automated accounts, bots, and AI-generated profiles are prohibited. You must also be legally permitted to enter into this agreement under applicable law.

You create an account by signing in with a supported provider (such as Sign in with Google or Sign in with Apple). You are responsible for the activity that happens under your account and for keeping access to your sign-in method secure. You may hold only one account at a time.

You can delete your account at any time from within the App. Deleting your account removes your profile and personal information as described in our Privacy Policy.

4.1 Sexual services

DateVibe is a social dating platform. You may not use the Service to solicit, offer, negotiate, arrange, advertise, or facilitate sexual services in exchange for money, goods, or any other consideration. Any communication — through messaging, date-slot descriptions, applications, or any other feature — that offers or solicits sexual services is forbidden, regardless of how it is framed.

4.2 Prostitution and escort services

You may not use DateVibe to operate, advertise, or facilitate escort services, prostitution, or any form of commercial sexual activity. Such conduct may violate the Protection of Communities and Exploited Persons Act (PCEPA) and other applicable Canadian law.

4.3 Human trafficking and exploitation

Any conduct related to human trafficking, coercion, exploitation, or any form of modern slavery is strictly prohibited and will be reported to the Royal Canadian Mounted Police (RCMP) and relevant authorities.

4.4 Misrepresentation

You may not create a false identity, impersonate another person, use someone else’s photos, or provide materially false information about yourself — including your name, age, location, occupation, or appearance. Catfishing — luring someone using a fictional persona — is prohibited.

4.5 Harassment and abuse

Harassment, stalking, intimidation, threats, hate speech, and discrimination based on race, gender, sexual orientation, religion, nationality, disability, or any other protected characteristic are strictly prohibited.

4.6 Unlawful content and unauthorized data collection

You may not post content that is illegal, defamatory, obscene, or that infringes another party’s rights. Scraping, harvesting, or otherwise collecting user data from the Service without our express written consent is prohibited.

Users may publish "date slots" indicating their availability for a social date, and other users may apply by proposing a concrete plan, activity, or experience. The host retains full discretion over which applications to accept or reject.

By publishing a date slot or submitting an application, you acknowledge that:

• You are genuinely available at the indicated date and time.
• If accepted, you commit to attending or cancelling with reasonable advance notice.
• Repeatedly failing to attend confirmed dates without cancellation may result in account restrictions.
• Plans proposed in applications must reflect genuine intentions; false or misleading plans constitute misrepresentation.

DateVibe uses artificial intelligence to estimate compatibility between users based on declared preferences, personality questionnaire responses, lifestyle tags, and AI interview responses. These results are informational guidance only and are not a guarantee of compatibility or of any dating outcome.

Compatibility is one factor among many. Human judgment, personal chemistry, and other subjective factors play important roles that our system cannot fully capture.

You retain ownership of the content you submit to DateVibe (photos, text, audio, video). By submitting content, you grant DateVibe a non-exclusive, royalty-free, worldwide license to use, host, display, and distribute that content solely for the purpose of operating the Service. We do not sell your content to third parties.

You are solely responsible for the content you post and you must have the rights necessary to share it.

DateVibe’s post-date review system is designed to promote honesty and accountability. Objective factors (such as attendance, profile accuracy, plan delivery, and respectful behavior) are partially visible, while subjective factors (such as personal connection or attraction) are kept entirely private.

You agree to provide honest and accurate reviews. Submitting false, retaliatory, or malicious reviews is prohibited. We use automated systems to detect anomalous review patterns and may adjust or remove reviews that appear fraudulent.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted or error-free, or that any match or date will result in a successful relationship or experience.

To the maximum extent permitted by applicable law, DateVibe and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including personal injury, emotional distress, loss of data, or loss of revenue — arising out of your use of the Service or any date arranged through it.

DateVibe is a platform that facilitates connections between users. We are not responsible for the conduct of any user, whether online or in person. Users meet at their own risk.

Your safety matters. We encourage all users to:

• Meet in public places, especially for first meetings.
• Share your date plans with a trusted friend or family member.
• Trust your instincts — if something feels wrong, leave.
• Report suspicious behavior, harassment, or safety concerns through the in-app reporting system.
• Call 911 in an emergency.

DateVibe has a zero-tolerance policy for violence, harassment, and any behavior that threatens user safety, and cooperates with Canadian law enforcement in investigations of illegal activity. To report a safety concern, contact safety@datevibe.io.

We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for conduct we deem harmful to other users or to the integrity of the Service. You may delete your account at any time from within the App.

We may modify these Terms from time to time. If we make material changes, we will notify users by email or through an in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

DateVibe is currently free to use. If we introduce paid features (such as subscriptions) or advertising in the future, those features will be governed by additional terms presented to you at that time, and our Privacy Policy and app privacy disclosures will be updated accordingly before they take effect.

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute arising from these Terms is subject to the exclusive jurisdiction of the courts of Quebec.
